7.6. Bushl reserves the right to remove, hide, or disable any Event that it believes, in its sole discretion, violates these Terms, applicable law, or the rights of third parties, or that may expose Bushl to liability. Bushl shall not be liable to you for any such removal.

8.5. Bushl reserves the right to cancel, reverse, or refund any Booking that it believes, in its sole discretion, is fraudulent, unauthorized, or in violation of these Terms. Bushl shall not be liable to the Organizer for any such cancellation.

8.6. The Platform supports the collection of passwords from Attendees during booking to enable persistent user identity for Tickets and Pulse Feedback. Organizers acknowledge that Attendees are not required to create full accounts and that password collection is solely for ticket security and identification purposes.

13.3. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM BUSHL OR THROUGH THE PLATFORM SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.

13.4. THE PLATFORM IS PROVIDED DURING A PRIVATE BETA PERIOD. BUSHHL DOES NOT WARRANT THAT ALL FEATURES ARE FULLY TESTED OR FREE FROM DEFECTS. YOU ACKNOWLEDGE THAT THE PLATFORM MAY CONTAIN BUGS, ERRORS, AND DEFECTS, AND YOU USE THE PLATFORM WITH THAT UNDERSTANDING.

13.5. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.

14. DISPUTE RESOLUTION — BINDING ARBITRATION AND CLASS ACTION WAIVER

PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO GO TO COURT AND YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION.

14.1. Agreement to Arbitrate: You and Bushl agree that any and all disputes, claims, or controversies (collectively, "Disputes") arising out of or relating to these Terms, the Platform, or your use of the Platform shall be resolved by final and binding individual arbitration, except as provided in subsection 14.5 below.

14.2. Seven-Day Opt-Out Right: You have the right to opt out of this arbitration agreement by sending a written opt-out notice to Bushl within seven (7) days of the date you create your account. If you do not send a timely opt-out notice, you will be deemed to have agreed to binding arbitration and waived your right to litigate disputes in court, including your right to participate in a class action.

14.3. How to Opt Out: During the private beta period, opt-out notices may be submitted through the in-app account settings (Settings → Legal → Opt Out of Arbitration) or by contacting Bushl support. After the beta period concludes, a designated legal contact address will be provided. Your opt-out notice must include: (i) your full name, (ii) your account email address, (iii) your organization name, and (iv) a clear statement that you wish to opt out of arbitration.

14.4. Effect of Opt-Out: If you timely opt out, disputes will be resolved in the courts of England and Wales, and the class action waiver in subsection 14.6 below will not apply to you.

14.5. Exceptions: Either party may bring a claim in a court of competent jurisdiction for: (i) small claims matters; (ii) claims of intellectual property infringement; (iii) requests for injunctive or other equitable relief; or (iv) claims arising from your failure to pay fees owed to Bushl.

14.6. Class Action Waiver: YOU AND BUSHL AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY. YOU AND BUSHL EXPRESSLY WAIVE ANY RIGHT TO BRING A CLAIM AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. UNLESS YOU TIMELY OPT OUT AS DESCRIBED ABOVE, YOU AGREE THAT THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS, AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF A REPRESENTATIVE OR CLASS PROCEEDING.

14.7. Arbitration Procedure: Arbitration shall be administered by the London Court of International Arbitration (LCIA) under its rules then in effect. The arbitration shall be conducted in London, England. The language of the arbitration shall be English. The arbitrator shall be a single arbitrator agreed upon by the parties, or if the parties cannot agree, appointed by the LCIA.

14.8. Cost Allocation: The parties shall share the costs of the arbitration equally, except that each party shall bear its own attorneys' fees and costs. If you are able to demonstrate that the costs of arbitration will be prohibitive as compared to the costs of litigation, Bushl will pay as much of the arbitrator's fees and costs as the arbitrator deems necessary to prevent the arbitration from being cost-prohibitive.

14.9. Pre-Arbitration Notice and Informal Resolution: Before initiating arbitration, the parties shall first attempt to resolve the dispute informally by sending a written notice of the dispute to the other party. The parties shall have thirty (30) days from receipt of such notice to resolve the dispute informally before either party may initiate arbitration.

14.10. Severability: If any provision of this arbitration agreement is found to be unenforceable, that provision shall be severed and the remaining provisions shall be enforced to the fullest extent permitted by law.

14.11. Survival: This arbitration agreement shall survive the termination of your account or these Terms.

14.12. No Legal Contact During Beta: Bushl is currently in a private beta period. During this period, there is no designated legal contact person or email address. Opt-out notices and legal inquiries should be submitted through the in-app account settings or by contacting Bushl support.

15. LIMITATION OF LIABILITY

15.1. TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL BUSHL, ITS DIRECTORS, OFFICERS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, LICENSORS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION:

15.2. IN NO EVENT SHALL BUSHL'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE PLATFORM, THESE TERMS, OR YOUR USE OF THE PLATFORM EXCEED THE GREATER OF:

a) THE AMOUNT YOU HAVE PAID TO BUSHL DURING THE PRECEDING TWELVE (12) MONTHS; OR

b) ONE HUNDRED BRITISH POUNDS (£100).
